The concept of the Islamic state, which is one of the main debates of Islamism, was an important source of motivation for Islamist movements, especially during the cold war. The debates in this context mostly focus on how to establish a relationship between the secular character of the modern state and Islam. In this study, Wael B. Hallaq's book titled The Impossible State: Islam, Politics, and Modernity's Moral Predicament will be reviewed. The book keeps this discussion current and offers a (...) different perspective. Hallaq's main thesis reveals why an Islamic state is not possible within the modern paradigm. Hallaq bases his thesis on the paradigm difference between modern law and Islamic law. İslamcılığın temel tartışma konularından biri olan İslam devleti kavramı, özellikle soğuk savaş döneminde İslamcı hareketlerin önemli bir motivasyon kaynağıydı. This paper examines Aristotle’s analysis of unenacted capacities to show the role they play in his discovery of the concept of actuality. I first argue that Aristotle begins Metaphysics IX by focusing on active and passive capacities, after which I discuss Aristotle’s confrontation with the Megarians, the philosophers who maintain that a capacity is present only insofar as it is being enacted. Using Heidegger’s interpretation as a guide, I show that Aristotle’s rejection of the Megarian position leads him to propose (...) that presence cannot be confined to activity. I also argue that this provides the context for Aristotle to realize that the relation between capacity and activity can be generalized as the relation between two ways of being. (shrink)

We present a mini review of the Stueckelberg mechanism, which was proposed to make the abelian gauge theories massive as an alternative to Higgs mechanism, within the framework of Minkowski as well as curved spacetimes. The higher the scale the tighter the bounds on the photon mass, which might be gained via the Stueckelberg mechanism, may be signalling that even an extremely small mass of the photon which cannot be measured directly could have far reaching effects in cosmology. We present (...) a cosmological model where Stueckelberg fields, which consist of both scalar and vector fields, are non-minimally coupled to gravity and the universe could go through a decelerating expansion phase sandwiched by two different accelerated expansion phases. Analyzing the concept of ḥikmah in early Islamic texts, this book brings earliest scholarly materials to the service of modern readers and thus offers a comprehensive contextualization of this subtle and elusive notion in the collective usage of early Muslim authors, especially in the works of lexicographers, exegetes, philosophers, and Sufis.

There are several passages in the Metaphysics where Aristotle explains ontological priority in terms of ontological dependence, but there are others where he seems to adopt a teleological conception of ontological priority. It is sometimes maintained that the latter priority too must be construed in terms of the former, or that the priorities in question are not both endorsed (or simultaneously endorsed) by Aristotle. The goal of this paper is to show otherwise; I argue that what is at issue are (...) two distinct priorities that Aristotle simultaneously endorses. (shrink)

On the standard interpretation of Metaphysics IX, Aristotle proceeds from the original sense of δύναμις and ἐνέργεια to an ontological conception of these terms. This should raise the question of what is not ontological about the former and what is ontological about the latter. To address these questions I discuss the commentaries by Heidegger and Menn, which alone come close to addressing these issues. But their readings cannot neatly distinguish between the two senses of δύναμις and ἐνέργεια that we find (...) in the Aristotelian text, thus compelling us to seek a better way of clarifying the standard interpretation, which I argue can be more precisely understood in the following way: δύναμις and ἐνέργεια in their customary meaning cannot be considered ontological in the sense that they have a particular locus among the categories, which is what sets them apart from their newer, ontological meaning. I conclude therefore that the text of Metaphysics IX can be understood as proceeding from an intracategorial conception of δύναμις and ἐνέργεια toward a transcategorial conception of these terms. This paper offers an interpretation of Aristotle’s concepts of dynamis and energeia (commonly translated as potentiality and actuality), and of the thematic progression of Metaphysics IX. I first raise the question of where motion fits in Aristotle’s categories and argue that the locus of motion in the system of categories are the categories of doing and suffering, in which case dynamis and energeia in respect of motion can also be understood as the dynamis and energeia of doing and suffering. Next, (...) I argue that the analogy that Aristotle draws in IX.6 is an analogy between the dynamis and energeia of doing and suffering and the dynamis and energeia of substance. Finally, I try to show that it is this analogy between the kinetic and non-kinetic variants of dynamis and energeia—and not the distinction between end-inclusive and end-exclusive activities—that provides the key to understanding the structure of Metaphysics IX. Sahabe ve tabiin dönemi âlimleri bu fiilî yöntemleri sonraki kuşaklara nazaran daha aktif kullanmışlardır. Autonomous vehicles (AV) offer promising benefits to society in terms of safety, environmental impact and increased mobility. However, acute challenges persist with any novel technology, inlcuding the perceived risks and trust underlying public acceptance. While research examining the current state of AV public perceptions and future challenges related to both societal and individual barriers to trust and risk perceptions is emerging, it is highly fragmented across disciplines. To address this research gap, by using the Web of Science database, our study (...) undertakes a bibliometric and performance analysis to identify the conceptual and intellectual structures of trust and risk narratives within the AV research field by investigating engineering, social sciences, marketing, and business and infrastructure domains to offer an interdisciplinary approach. Our analysis provides an overview of the key research area across the search categories of ‘trust’ and ‘risk’. Our results show three main clusters with regard to trust and risk, namely, behavioural aspects of AV interaction; uptake and acceptance; and modelling human–automation interaction. The synthesis of the literature allows a better understanding of the public perception of AV and its historical conception and development. It further offers a robust model of public perception in AV, outlining the key themes found in the literature and, in turn, offers critical directions for future research. (shrink)

This article aims at examining the limits of change in the field of worship through a study on the origins of the ḥukm[religious ruling] of Shawwāl fasting that is widely practiced in the different parts of Muslim world. The study, firstly, deals with the evolution of the ḥukm of Shawwāl fasting chronologically among four sunnī schools of law, then analyzes the solitary reports on the topic. It concludes that in Mālikīand Ḥanefīschools, the ḥukm of this specific worship changed within the (...) limits of karāha [reprehensibility], ibāha [permissibility], and nadb [recommendation]. This ḥukm was constructed based on solitary reports which later became a paradigmatic source of religious legitimacy in the Ḥanbalīschool beginning with the eponymous Imām and in the Shāfiʿīlong after the founding authorities. It also claims that it is strongly probable that the solitary reports on the topic go back to a deduced opinion in the age of companions, but then reached to a form of prophetic solitary report in the corpus of hadīth reports. Ultimately, this specific worship that has restricted number of fasting was established with the paradigmatic effect of the approach to solitary reports as the only authentic way of transmitting the sunna, even though it is at odds with the fact that this worship had not been implemented in the first two centuries after hijra, i.e. contrary to the established practice [ʿamal]. Summary: The issue of change of rulings in Islamic law comes up frequently on various occasions, and an increasing number of academic studies are trying to determine the characteristics and limits of this change in numerous books, articles and papers. These studies mostly seem to focus on bringing together the arguments that can be compiled under the title of ‘the flexibility of Islamic law in response to the challenges of modernity’. Although the change of rulings in Islamic law is an undeniable fact, reading it only from the lens of the change in Islamic law depending on the requirements of time is an inadequate reading. The change of rulings in Islamic law has different motives; and the change of time, more precisely the change of custom, is only one of them.On the other hand, another issue that comes up in relation to the change of rulings is the claim that this change can only take place in terms of the rulings regulating the interpersonal relations, i.e. muʿāmalāt. In fact, this claim relies on the abovementioned approach that limits the change in Islamic law with the change of custom. Hence, because other two main areas of Islamic law, worships (ʿibādāt) and punishments (ʿuqūbāt) are not open to change through custom, their rulings will not change at all. This article will try to reveal that the change in rulings might reside in a sort of another change emerged in relation to the sources of these rulings, which is a neglected point. Thus, by exposing that the field of worships which is mostly considered as a closed area for change in rulings is actually open to it, this article will examine the limits of this change.For this analysis, the article deals with the fasting of six days in the month of Shawwāl as an example, which is widely practiced in various parts of the Islamic world. The main evidence on which this fasting is based on is a report transmitted in the considerably authentic hadith sources of Ahl al-Sunnah, which reads as follows “Whoever fasts the Ramaḍān and adds six days from Shawwāl, will get reward of the entire year”. This fasting, which is the subject of a great agreement on its ruling as recommended (mustaḥāb) practice today, was actually regarded as reprehensible (makrūh) by the two great eponymous jurists of the first two schools of law in the second Hijrī century, namely Mālik b. Anas and Abū Ḥanīfa. In his al-Muwaṭṭaʾ,Mālik clearly expresses that he did not recognize any scholar who keeps this fast, and that no [authentic] report has reached him on this. The fact that both Mālik b. Anas and Abū Ḥanīfa declared an opinion on the subject shows that this practice started to appear in the first half of the second ḥijrī century as a practice or as a solitary report (khabar al-wāḥid). However, both imāms have stated that such a specific worship would be makrūh. In spite of these very sharp expressions, the schools of law, which were founded by the followers of these two eponymous scholars, abandoned their views and widely accepted Shawwāl fasting as mustaḥāb. This article examines why this sharp change occurred in a worship in the schools of law and in which way it took place.Accordingly, the fundamental motive in this change is a paradigmatic transformation in understanding and identifying the sunna as a source of normativity. Although an agreement was formed on the validity of solitary reports as a source of knowledge in the second ḥijrī century, it was not yet accepted that these narrations are identical to sunna as a source of normativity. For that reason, both Abū Ḥanīfa and Mālik did not hesitate to reject any solitary report that contradicted a stronger evidence. However, as a result of the extraordinary efforts of Ahl al-Ḥadīth, the epistemic value of solitary reports has reached to an authority equating them to the sunna with a very rapid acceleration as of the end of the second century and throughout the third century. This situation led later scholars of schools to abandon the views of the eponymous scholars of these schools on certain topics in favor of certain solitary reports. This was also the process for the change in Shawwāl fasting.This thesis will be put under two headings, a section that tries to determine the periods and processes for the Sunnī schools of law in considering this fasting as mustaḥāb; and another section that provides an evaluation of transmitted reports in relation to the Shawwāl fasting. Accordingly, in the Mālikī and Ḥanafī schools, due to the effect of the reports, the ruling of Shawwāl fasting has been transformed from makrūh into the mustaḥāb as a result of the interpretational activities that started in the fourth ḥijrī century. Shawwāl fasting was accepted as mustaḥāb in the Shāfiʿī school, although there was no transmitted opinion on the subject from the founding imāms, in the fifth ḥijrī century; and in the Ḥanbalī school directly by the founding imām Aḥmad b. Ḥanbal, whose main aim was to follow a concept of religion that puts the transmitted reports at the center. When the reports on the subject are examined, it demonstrates that the mustaḥāb ruling is mainly rooted in a report by Saʿd b. Saʿīd transmitted in the famous hadīth compilations including Muslim’s Ṣaḥīḥ.Yet, this report was criticized in its both chain and text. Combining the facts that the same report with the same chain was also transmitted as the words of the companion in some sources and the verse that declares good deed will be rewarded ten times higher than what it deserves will make the following explanation a valid one: As Mālik put it such a fasting practice was commonly unknown to the Muslim society in the first two centuries after the ḥijra. Sometime after the death of the Prophet, an inference was made probably by a companion(s) as that it would be a good deed if someone who fasted an entire month already and got used to the fasting to fast six more days in order to get a reward of fasting for the entire year according to the verse that rewards good deeds with ten times higher. Since it is a recommended practice in essence, i.e. fasting for the sake of Allah, this inference transformed into a report and easily passed through the filters of hadīth scholars who are linked to a sort of piety promoting worships among people. After the solitary reports gained an authority to the extent that they can rarely be challenged, the followers of later schools of law preferred to get in a process of re-interpreting the opinions of their imāms in order either to reconcile them with the content of report, or at least to show why these imāms actually spoke against this fasting. Eventually, the later scholars of madhhab decided for the standard opinion of the madhhab depending on the reports in favor of the Shawwāl fasting rather than following their eponymous imāms. The subject “rule”, which is one of the most fundamental issues of the Islamic legal theory (usūl al-fiqh), has been in the center of methodological debates. There is one important term in this regard, which should be studied very carefully: Khiṭāb(speech) of the God. It is because that, especially since the first period of Islam, it has been taken with some significant terms in the field of Kalāmsuch as Husn (pretty; good), Qubh (ugly; evil), and the quality of God’s talk. (...) Yet, adopting this term in the description of the “rule” shows that Fiqh is based on divine inspiration, and it also emphasizes that even though there are some differences in details, wisdom of human being is not ignored when adjudicating. Moreover, it suggests that the validity or methodological accuracy of the “rule” which is adjudicated with ruling case is related to the connection through the term speech or divine inspiration. In this regard, Kalāmdimension of the term and its affect to legal theoretical discussions are very important in terms of historical process of the definition of the “rule” in Islamic law. In this study, I tried to examine whether or not the term “khiṭābof the God” which is used in the definition of the “rule” formed a limitation for consideration of legal evidence in Islamic law and if there is any limitation for the legal evidence regarding being only in the Qur’ān and the Sunnah due to this definition.SummaryThe “hukm (rule, arbritation, judgment, God’s will)”-as the backbone notion in usūl al-fiqhis one of the significant key notions discussed in the legal theory. Specifically, the term “khitabullah” mentioned in the definition of hukmis noteworthy to investigate. Since the early formation period of Islamic law, the term khitabullahhas been embraced along with the theological subjects: “husnand qubuh(the good and evil) and kalām(the attribute of speech to Allah)”. The term “khitabullah” in the definition of hukmemphasizes that indeed the source of fiqhis the revelation (wahy) and also emphasizes that the function of reason (‘aql) is not ignored in the process of adjudication- even if there are some nuances in details.Additionally, it presents that the validity or methodological accuracy of the “rule” which is adjudicated with ruling a case is connected to the term speech (khitāb), or in other words to revelation (wahy).On the whole, in the legal theory, the rule of Sharī‘ah is defined as God’s khitab(the communication of God), which means the demand of God relating to the acts of those who are subject of law or the effect of the khitābon the acts of those persons. Although, in the early formative period various explanations were made about what the rule is, it can be understood that the present definition of hukmbegan to evolve towards the end of the 5thcentury (A. H.). It is clear that al-Ghazālī had an impact on the formation of this definition. It is because al-Ghazālī defined the rule of Sharī‘ahas “the communication from God relating to an act of the person who is the subject of law”. After al-Ghazālī, al-Rādī and al-Baydāwī added to al-Ghazālī’s definition the words “iqtidā and takhyīr” and Ibn Hājib added “wad‘an”. Whereas in the Mutakallimun(theologians) tradition, Ibn Hacib's definition was preferred, Fuqaha(jurists) tradition chose two definitions-resembling each other: “Those coming to exist with the khitāb” and “the effect of God’s khitāb”.Along with al-Ghazālī’s definition, the concept of khitābcarved out a niche for itself in it and became the main element of the definition. It is understood that some discussions in the field of theology, such as husn-qubhand God’s attribute of speech have been effective on the interpretation of the concept of khitāb. The Ash‘arilegal theorists argue that the good and evil are not attributes of the self / the acts, whereas the Maturidi legal theorists argue that the exploration and determination of these attributes is rational and thus, the verdict reached via this rationale is lawful. The Maturidi legal theorists initiated the concept of being subject of law with the concept Sharī‘ah and in the line with this opinion; they defined hukmon the basis of khitāb. On the other hand, the Mutazilites’ claiming the attribute of good and evil are inherent feature of the act, did not define hukmon the basis of the khitābaccording to their theological understanding. The word of khitābassessed with God’s eternal speech (al-kalām al-azalī) has been approached from various aspects: for instance, whether the presence of the addressee is mandatory. The early Asharites scholars (mutaqaddimun), in particular Imam Asharī, did not entitle the eternal speech as khitāb. They consider that the presence of the interlocutor is necessary in the conversion of Kalāminto khitāb. The mutaakhirunAsharites (successors of the early Asharites scholars) did not consider the presence of the interlocutor necessary, thus they viewed the eternal speech as khitāb. The former identification of the hukmwith khitābby the early Ashari legal theorists caused to the problem of whether hukmis adventitious or not. Therefore, this approach was criticised by the Mutazilites. On the other hand, the Maturidi and Mutezilite legal theorists accept that hukmis adventitious; hence they do not consider as a problem naming the eternal speech of God as khitāb.When the historical course is examined, it can be said that one of the important aspects of the development of hukm’s definition is the use of khitāb. Khitābin some cases is used without possessive construction, in other cases it is used with possessive construction with God, or in possessive construction with shar’ or Shāri’. The most important one within these possessive constructions is the notion “khitaballah”. Therefore, it is necessary for khitaballahto be approached from the angle of the legal theory. In comparison to other terms, this notion narrowed the scope of the rule down. In the meanwhile, it raised the question: how the rule deduced via legal evidences can be incorporated in khitāb? As a consequence of this question, some legal theorists, such as Tūfī, proposed another definition by adducing this question.Although it is commonly accepted that the rules deduced via other evidences are within the context of the khitāb, there are also different descriptions about the concept of khitaballah. The rule is not limited to khitaballahin the conception of traditional interpretation accepting the khitābas eternal speech or literal speech (al-kalām al-lafzī). Because either all evidences are within the context of the khitāb,which is the eternal speech or other evidences are within the context of the khitāb,which is the literal speech. Thus, each result coming to exist with the other evidences is part of the Islamic law. But not all of these rules are considered equal to each other. Because each rule which is deduced from indisputable origin (qatii al-thubut) and is deduced from completely explicit sources (qatii al-dalala) are accepted as the word of God or the Prophet. On the other hand, other rules deduced via jurisprudence- in other words by jurist’s own value of judgment is viewed as the virtual rule (al-hukm al-zāhir). Such rules do not express absolute certainty. It is unacceptable for these rules to be described as the word of God or the Prophet. In this way, it is clearly understood that the concept of khitaballahmentioned in the description do not introduce restriction to the evidences ofSharī‘ah.We do not see a contradiction when the indefinite rules of Islamic law included in the context of khitāb. Because ijtihāddoes not aim to produce a new rule, on the contrary it functions in order to find out the already existing rules. The legitimacy of the rule obtained through ijtihādemerges from the way that this rule is deduced from the khitāb,which directly or indirectly represents the divine will. In addition, according to us, this legitimacy is not merely limited to versification and conception of the khitāb, but it also includes the function of the reason in (reasonable of the) khitāb. As a matter of fact, trying to solve unlimited cases with limited texts is difficult- in fact this is impossible. The majority of the legal theorists also share this opinion. Then, there is no obstacle in accepting that each rule obtained by authentic source and methodology can be considered part of Islamic law by implicating the rule in the context of khitāb(which represents the divine will) - although it may contain error and presumption. The value of knowledge and deeds of the methodology of the reasoning defined such as “due to they have a common effective cause (ʿilla), the provision of principle (aṣl) is given to the branch (farʿ)” has been the subject of debate from the first period. That is, on the one hand there are some who reject the method of analogical reasoning by saying that although the authority of legislation belongs to Shāri’only, this method is to make legislation in the religion (...) and that its value in knowledge is condemned as conjecture by the injunction (naṣṣ). They also put forward some arguments as well. However, on the other hand the majority accepts the method of reasoning as an essential and sharʿī (religious) argument. This study will not compare the opinions of those who reject qiyās and that of those who approve it. By means of religious and rational evidences this study will deal with that the method of analogical reasoning is not a rational effort simply, that the knowledge gained by it is not a conjecture criticised by the injunctions, that it is the highest ranking conjecture based on the proof, and that it is sufficient to practice in the field of law. After a general frame is drawn about qiyās, this article has been limited with the place of qiyās in the hierarchy of evidence and its value concerning knowledge and practice. This article wants to clarify the discussions related to the value of knowledge and deeds of the methodology of the reasoning. (shrink)

Introduction Tourette Syndrome is a childhood onset disorder characterized by vocal and motor tics and often remits spontaneously during adolescence. For treatment refractory patients, Deep Brain Stimulation may be considered. Methods and Results We discuss ethical problems encountered in two adolescent TS patients treated with DBS and systematically review the literature on the topic. Following surgery one patient experienced side effects without sufficient therapeutic effects and the stimulator was turned off. After a second series of behavioural treatment, he experienced a (...) tic reduction of more than 50%. The second patient went through a period of behavioural disturbances that interfered with optimal programming, but eventually experienced a 70% tic reduction. Sixteen DBS surgeries in adolescent TS patients have been reported, none of which pays attention to ethical aspects. Discussion Specific ethical issues arise in adolescent TS patients undergoing DBS relating both to clinical practice as well as to research. Attention should be paid to selecting patients fairly, thorough examination and weighing of risks and benefits, protecting the health of children and adolescents receiving DBS, special issues concerning patient’s autonomy, and the normative impact of quality of life. In research, registration of all TS cases in a central database covering a range of standardized information will facilitate further development of DBS for this indication. Conclusion Clinical practice should be accompanied by ongoing ethical reflection, preferably covering not only theoretical thought but providing also insights in the views and perspectives of those concerned, that is patients, family members and professionals. Onlara göre iman, dünya ve ahiret açısından, en açık tanımına da “kalp ile tasdik ve dil ile ikrar” olarak erişmiş oluyor ki, böyle bir anlayış bir kapalılık ihtiva etmez ve herhangi bir kapalılık durumunu da reddeder.Özet: Ebû Mansûr el-Mâtürîdî, Ehl-i Sünnet’in iki ana damarından birini temsil eden, Hanefî-Mâtürîdî geleneğin önemli düşünürlerinden biridir. Ebû Hanîfe’nin görüşlerini açıklama ve sistematik hale getirmesinin yanında o, hem ele aldığı konular hem de takip ettiği metodoloji açısından orijinaldir. Hanefî-Mâtürîdî geleneğin iman anlayışı, günümüz dünyasının gizli, kapalı (takiyyeci) iman anlayışlarına önemli bir cevap olma özelliği taşır. Onların iman davranış ilişkisi konusundaki söylemleri de günümüzün dışlayıcı iman anlayışlarına anlamlı bir cevaptır.Mâtürîdî düşüncesinde iman, Allah katından geldiği kesin olarak bilinen şeylerin anlaşılması, kabulü ve tasdik edilmesi olarak görülür. Mâtürîdîlere göre açıklık ve kesinlik, imanda önemli unsurlardır. Aynı açıklık ve kesinliğin, bireylerin iman anlayışlarına da yansıması gerekir. Bir müminin imanı, olabildiğince kesin, olabildiğince açık ve şeffaf olmalıdır. İmanı akli bir zorunluluk olarak Mâtürîdî’ye göre varlıkların güzelliğini aklî olarak bilmek mümkün olduğu gibi, benzer şekilde imanın güzelliğini de aklen bilebilmek mümkündür. Bu araştırma Mâtürîdîlerin iman alanındaki temel görüş ve kabullerine dayanarak, bu anlayışın imanı örtülü, kapalı bir temelde ele almaya imkân verip vermediğini tartışmaktadır. İmanı akledilebilenlerin en güzel ve değerlisi olarak gören Mâtürîdîler, Allah’a inanmayı aklî bir gereklilik kabul ederler. Onlar açısından sorumluluğun temel şartı akıldır ve imanın hakikati de ancak düşünme ve akıl yürütme yoluyla bilinebilir. Mâtürîdîlere göre iman, özü itibarıyla kalbin tasdikinden ibarettir ve öncelikli olarak o, bir kalp işidir. Bilgiye dayanması nedeniyle tasdik, önemli bir açıklık ve kesinlik unsurudur. Mâtürîdî’ye göre imanın kararlı ve ayrılmaz ögesi, tasdiktir. Tasdikin pek çok türü mevcuttur. Bununla birlikte Mâtürîdîlere göre imanın en kararlı ve önemli unsuru, kalbin tasdikidir. Kalbin tasdikine dayanmayan bir iman, Allah katında geçerli olmadığı gibi ahirette de kurtarıcı bir iman değildir.İmanın kalbin tasdiki olarak tanımlanması önemlidir. Mâtürîdîler açısından tasdik, bilgiye dayanır ve bu nedenle de kesinlik ve kararlılık ifade eder. Başka bir deyişle o, inanılması gereken şeylerin kesin bir bilgisi ve onayıdır. Mâtürîdîlere göre açıklık ve kesinlik iman söz konusu olduğunda hayatîdir ve bu nedenden dolayı da kalbin tasdikine güçlü vurgu yaparlar. Bu nedenle iman, en güçlü, en kesin ve açık anlamını kalbî tasdikte bulur ve öncelikli olarak bir kalp işidir. Mâtürîdî’ye göre iman bir inanç meseledir; inanç ise ancak kalp ile olur. Bu nedenle de imanı kalbin tasdiki olarak tanımlamak aklî bir gerekliliktir. İmanın kalbin tasdikine dayanması anlamında, birey ile Allah arasındaki ilişki açıktır ve kuşku barındırmaz. Mâtürîdîlere göre tek başına kalbin tasdiki yeterlidir. Kalbin tasdikine dayanan böyle bir iman, geçerli imandır ve daha çok ahiret hayatına yöneliktir. Ancak onun insana ve dünyaya bakan yönü kapalı ve belirsiz kalmaktadır. Böyle bir inancı insanların bilebilmesi mümkün değir, zira kalpteki imanın varlığı onlar açısından kapalıdır. Yalnızca kalpte olan bir imanı yalnızca Allah bilebilir. Bir mümin için kalbin tutumu tek başına yeterli ve tasdikin diğer boyutları da gerekli değilse, o zaman iman bireysel ve kişiye özgü kalmaktadır. Bunu bir çeşit kapalı (insana açık olmaya) iman türü olarak görmek mümkündür. Bu durum ise tasdikin ihtiva ettiği açıklık ve kesinlik boyutuyla çelişir.Bununla birlikte Mâtürîdîler de imanın yalnızca kalp ile tasdik ve ahirete bakan yönüyle tanımlandığında ortaya çıkan bu riskin farkındadırlar. Ancak şu acıktır ki, onlar imanın yalnızca kalbin tasdiki olarak açıklanmasını, ahirete dönük ve teknik anlamda bir doğrulama türü olarak görürler. Mâtürîdîlerin büyük çoğunluğu, imanın insana bakan yönünü de hesaba katarlar ve bu açıdan onlar, imana kalbin tasdiki kadar dilin ikrarının da eşlik etmesi gerektiğini düşünürler. Bu durumda imanın en açık ve en şeffaf anlamına, kalb ile tasdik ve dil ile ikrar olarak tanımlandığında kavuştuğunu söylemek mümkün olacaktır. Mâtürîdîlere göre iman hem ahiret hem de dünya hayatı açısından en açık ve en kesin anlamına “kalb ile tasdik ve dil ile ikrar” olarak tanımlandığında erişir. Böyle bir anlaşım bir kapalılık barındırmaz ve herhangi bir kapalılık durumunu da reddeder. Diyebiliriz ki, Mâtürîdî düşünürler, imanın dünya hayatına bakan yönünü dikkate aldıklarında, kalbin tasdikinin ötesinde, imanın diğer boyutlarını da hesaba katarlar ve iman anlayışlarını bu açıdan inşa ederler. Kalbin tasdiki, dil ve davranış vasıtasıyla nesnel alana taşınır ve gözlemlenebilir duruma gelir. Diğer taraftan Mâtürîdîler, kalp ile tasdike dayanmayan salt bir dil ile ikrarı, imanın geçersiz bir biçimi olan nifaka özdeş görürler. In the fatwas given today related to whether individual or social life, the area of jawāz either has been very wide or very narrow. Those, who feature the behavior making prohibited things lawful, have nearly defined even necessity within the pragmatism on the basis of need and they keep the area in question very wide. On the other hand, those who confine the evidence of maṣlaḥa to a methodological principle, have nearly disregarded needs in solving individual and social problems. Whereas, (...) in the fiqh, the needs have been categorized as necessary/ḍarūrī, human want/ḥājī and making beautiful/taḥsīnī, and many principles have been constructed for taking stock of them. One of the principles is the lex of “Need/al-Ḥāje, general or particular, is dealt with as to meet necessity/al-Ḍarūra.” When it is determined how this lex has come out since the first period and its conditions in the context of implementation are determined, it will be come out that necessary cannot be reduced to need. In the same way, it will be come out that the maṣlaḥa is not an evidence disconnected with life. So, in the article, we will discuss the concepts of necessary and need. Then, we will show what the conditions to be considered in implementation of this lex are, what its base is in the sharia, how it has come out since the first period, and how it has been used in actual issues of the fiqh as well as in a specific example. Thus, with this study, we purpose to contribute to the solution of the actual issues of the fiqh. -/- SUMMARY The notions of need and necessity (ḍarūra, ḥāje) which are of four notions cited in the lex were individually examined and the differences between them were explained. The notions of general or particular (umūmī, khuṣūṣī), because of their using as adjective of the notion of ḥāje, were explained in the context of it. In the literature, the conception of ḥāje was used in the meaning both for all needs containing ḍarūra and just for needs apart from ḍarūra. A similar situation applies to the conception of ḍarūra. Ḍarūra having two descriptions was used in the meaning of ḥāje at times. This closure in using has caused the idea that both concepts have the same notion. In fact, from this point of view, there are the implications about that the lex is unnecessary. In this study, it is purposed that the mentioned idea and implications are wrong. As a requirement, the differences between the mentioned concepts were also examined under a separate title. -/- As for the notions of umūmī and khuṣūṣī, the scope of umūmī and khuṣūṣī ḥāje were not transparently defined and were just explained through examples in the classical period. In the context of ḥāje, the descriptions about the scope of these notions have been done after the lex took its final shape and became popular in this shape. According to these descriptions, umūmī ḥāje is the needs regarding all community. Khuṣūṣī ḥāje is the needs regarding a certain group in the community. There are interpretations as well about that individual needs must be dealt with in the scope of khuṣūṣī ḥāje. This study has same opinion. Taking into consideration of the historical development of the lex, this situation has been more clearly understood. Taking into consideration of the historical development of the lex, it is seen that the first person to make the lex a current issue is Juweynī (d. 1085). Juweynī mentioned the lex in different shapes. These combine in the point of umūmī ḥāje: “Umūmī ḥāje is dealt with as khuṣūṣī ḍarūra.” Juweynī not mentioning the notion of khuṣūṣī ḥāje in the lex shows that there is the differentiation between umūmī and khuṣūṣī ḥāje in his mind. Juweynī has a clear attitude in umūmī ḥāje while is hesitant in khuṣūṣī ḥāje. Another point which he is clear is that the needs dealt with as ḍarūra is not pure advantage and relaxation and it must have some conditions. Likewise, Gazzalī (d. 1111) and ‘Izz b. ʿAbd al-salām (d. 1262) continued the clear attitude of him. Both asserted some conditions about ḥāje dealt with as ḍarūra. But both did not mention any notation to imply these conditions in the lex. However, Ibn al-Wakīl (d. 1317) seems to want to show all ḥāje not to be dealt with as ḍarūra by adding the notation of in some situation: “Umūmī ḥāje is dealt with as ḍarūra in some situation.” In the historical development, it is seen that the first person to mention the notion of “khuṣūṣī ḥāje” in a lex is Zarkashī (d. 1392). But he mentioned this notion in another lex not in the lex in question. It is claimed that the addition of “khuṣūṣī ḥāje” to the lex was done in time of Ibn al-Wakīl or before and Zarkashī divided the lex in two as umūmī ḥāje and khuṣūṣī ḥāje. But this study proves for the mentioned claims to be unsuitable the historical development. Because, the first person to mention the notions both of umūmī ḥāje and khuṣūṣī ḥāje in one lex is Suyūtī (d. 1505): “Ḥāje, umūmī or khuṣūsī, is dealt with as to meet ḍarūra.” The lex has been fixed and become popular as it is. After this, especially in the recent period, the clear definitions have started to be done regarding what scope the notions of umūmī and khuṣūsī ḥāje in question in the lex is and the conditions about ḥāje have been dwelled on. In this study, the conditions in question have been treated under four items. In this study, this conditions have been analyzed with regard to functionality of the lex. It has been determined that the idea claimed about that ḥāje must not oppose to a special base, in the context of the first conditions especially, will cancel the functionality of the lex. The current use of the lex, because of the study’s boundaries, has been dealt with over a specific example topic. The issue of being a resident has been preferred as an example topic. Though there is an alliance about having a residence as a need, there is a conflict about the buying a residence by bank credit. While some have not allowed this by claiming that credit is against to a special base, some have allowed it on the basis of this lex. According to the second group, when its conditions are met, the buying a residence by credit is permissible. Because, residence is among essential needs. In this study, it is stated that the preferred opinion is this. However, by taking into account the spirit of sharia it is expressed that every need for having a residence cannot be dealt with as necessity. It has been emphasized that instead of accepting everything as a need dictated especially by the consumerism that elevates human desires to an uncontrollable level, identifying a suitable need for our own values is important. This study deals with the lex of “Need, general or particular, is dealt with as to meet necessity” used in the fatwās today. The study determining the historical development and break points of the lex and the conditions argued about it examines daily use of it on the basis of a current example. İçinde bulunduğumuz çağ, modernizm ile birlikte din ve geleneğe yer vermeyen metafizikten kopuk bir bilim inşa etmiştir. Zengin bir bilim geçmişine sahip İslam medeniyeti ise değerleri ile uyuşmayan bu bilim sahnesinin dışında kalmıştır. Kur’an-ı Kerim gibi tabiatı da hakkın tecellisi kabul etmiş bu medeniyette bilimin yeniden inşası için geleneğin vazgeçilmez olduğunu belirten İlhan Kutluer, tarihi süreç içerisinde yıpranmış, anlamını ve eski canlılığını yitirmiş unsurları yeniden düşünce tarihinin malzemesi haline getirmeyi amaçlamıştır. İslam’ın klasik çağında olduğu gibi günümüzde de bütün disiplinlere aynı (...) ihtimamın gösterilmesi gerektiğini vurgulamıştır. Eşʿarîliğin son aşamasını temsil eden Îcî’nin argümanları, ekoldeki geleneksel ve felsefî yaklaşımları yansıtmaktadır. Bu makale Îcî’nin Muʿtezile’nin ahlâkî realizmine karşı kullandığı temel argümanlarını sunmaktadır. Çalışmanın amacı Îcî’nin argümanlarını değiştirmeden sağlam bir şekilde sunmak, açıklamak, itirazları tartışmak ve sonunda güçlü ve zayıf yönlerini değerlendirmektir. Makalenin amacı Muʿtezile’nin argümanlarını açıklamak değildir; yine de Îcî’nin argümanlarını daha net anlamak için bazı açıklamalar yapmaktadır. Makalenin ilk kısmında Eşʿarîler ile Muʿtezile’nin ahlâk anlayışları arasında belirgin bir çizgi çizmektedir. Tartışma noktasını belirtip kelâmî argümanlar için zemin (...) hazırlamaktadır. Îcî’nin argümanları üç kısma ayrılmıştır. Birinci kısımda Îcî’nin Muʿtezile’nin ahlâkî temellerine şüphe düşürmek için insanın seçme özgürlüğünü ortadan kaldırmak için polemik argümanını sunmaktayız. Argümana karşı eleştirileri tartıştıktan sonra Îcî’nin insanın gücü ve seçme özgürlüğü konusundaki gerçek görüşünü ortaya koyuyoruz. İkinci kısım, intrinsik değerler görüşüne karşı üç argüman ihtiva etmektedir. İlk iki argüman Îcî tarafından benimsenmiş, üçüncüsü ise genel bir şekilde diğer Eşʿarîlere atfetmiştir. Bu iki argüman yalanı ve doğruyu söylemenin intrinsik etik değerleriyle ilgilenmektedir, üçüncüsü ise Eşʿarîlerin meşhur: “Bir araz başka bir araz üzerinde konamaz” deyişine dayanmaktadır. Makalenin son kısmı, Îcî’nin Muʿtezile'nin ahlâkî vecihler teorisine karşı argümanını tartışmaya ayrılmıştır. Îcî’nin argümanını tartışmadan önce teori ve taraftarları hakkında yeterli bir açıklama yapılmıştır. Ayrıca Îcî’nin ve Muʿtezile’nin ilâhî ahlâk anlayışına dair kısa bir giriş, argümanın içinde tartışılmaktadır. Adalet ve hikmet gibi bazı ilahî nitelikler Eşʿarî ve Muʿtezile’nin bakış açılarından ele alınmaktadır. Sonuç olarak makale, Îcî’nin Muʿtezile’nin ahlâkî realizmine karşı argümanlarını açık ve net bir şekilde ortaya koymakta, itirazları sunup değerlendirmekte ve argümanların güçlü ve zayıf yönlerini göstermektedir. Son olarak, Eşʿarîlerin Muʿtezile’ye karşı ahlâkî argümanlarını daha etkili bir şekilde anlamak için bir çözüm önermektedir. (shrink)

Bu çalışma Yeni Platonculuğun kurucu metni olan Enneadlar’ı merkeze alarak Plotinus’un ahlâk, erdemler ve adalet konusundaki düşüncesini ortaya koymayı hedeflemektedir. Bunu gerçekleştirmek için Enneadlar’ın I, 2, 19. bölümü tüm detaylarıyla ele alınacaktır. Elbette modern ve çağdaş dönemde bu konu etrafında gelişen literatür de göz ardı edilmeyecektir. Plotinus’un erdem tasavvurunun Platon ve Aristoteles’ten daha farklı bir yere evirildiği, Plotinus öncesindeki ahlâk anlayışının ve erdemler sistematiğinin daha realist bir yerde konumlandığı, onun görüşünün ise “Tanrı’yla benzeme” ideali etrafında şekillenen yarı mistik bir felsefî (...) ahlâk tasavvuruna dönüştüğü öne sürülecektir. Ayrıca erdemlerin yüce ve bayağı âlemde hikmet, şeceaat, adalet gibi eş adlı isimlerle adlandırılmasına karşın yüce âlemde Ruhun erdemlerle özdeş olduğu, bayağı âlemde bedenle birlikte bulunan nefsin ise erdemleri arınma yoluyla edinerek tanrıya benzemeye çalışması gerektiği sonucuna ulaşılacaktır. Sonuç olarak Plotinus’un, Platon’dan Descartes’e kadarki süreçte neredeyse iki ana metafizik öğretiden birinin sahibi oluşu ve etki gücü bakımından Aristotelesçiliğin karşısına esaslı farklılıklarla birlikte Platonculuk görünümünde konumlanışı sadece metafizik öğretide değil ahlâk felsefenin temel kavramları ve kavrayışında da bir dönüşüm oluşturmuştur. Birey/fert merkezli bu kavrayış, ahlâki dönüşümü başlangıç düzeyinde siyasi erdemlerin de katkısını yadsımadan ama kişinin kendine yönelmesi ve nefsinin bedensel kavrayış biçimleri ve dil başta olmak üzere tüm sınırları geride bırakıp arınma idealine ulaşmayı hedefleyerek kendisinden önceki perspektiflerden farklılaşmış ve kendisinden sonraki pek çok felsefî, dîni ve mistik ekole öncülük etmiş bir insan tasavvuru sunmuştur. Plotinus’un felsefesinin bütünü dikkate alındığında bu içe dönüşün, dış dünyayı yok saymak anlamına gelmediği, dış dünyadaki belirlenmiş ölçülere göre erdem sahibi olmanın yetersiz görüldüğü bu nedenle bu aşamadan sonra içe dönerek arınmak gerektiği fikrinin savunulduğu öne sürülmüştür. Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında burada tartışma konusu yapılan hadisler haberî sıfatları konu alan ve müşkil nitelikte olan rivayetlerden oluşmaktadır. Bu rivayetleri genelde Bişr el-Merîsî ve taraftarlarının tecsîm ve teşbîh içerdiği iddiasıyla münker kabul ettikleri görülmektedir. Ehl-i re’y özellikleri taşımakla birlikte ilahî sıfatlar konusunda Mu’tezilî bir anlayışa sahip olduklarından tenzih anlayışları gereği sıfatları reddetmektedirler. Yaratılmışlara ait niteliklerin yaratıcıya nisbet edilmesini tenzîh anlayışlarına aykırı gördüklerinden bu tür müşkil rivayetleri ya kendi anlayışları doğrultusunda te’vîl ya da reddettikleri gözlenmektedir. Sert bir (...) ehl-i hadîs âlimi olan Osman ed-Dârimî ise, ayet ve hadislerde bildirilen ilahî sıfatlara iman edilmesi gerektiğini kabul etmektedir. Bu anlayışı sebebiyle bu rivayetlerde bildirilen haberî sıfatlara da te’vîl etmeksizin lafzî anlamıyla yaklaşmakta; kendi görüşü doğrultusunda Bişr el-Merîsî ve taraftarlarının yaptığı te’vîlleri reddetmekte, bu te’vîllerin ta’tîle yol açacağını ileri sürmektedir. Bu rivayetlerin lafzî (literal) anlamları doğrultusunda anlaşılması gerektiğini savunmaktadır. Bu hadisler üzerinde yapılan tartışmalar, temel hadis eserlerinin yazıldığı dönemde Ehl-i re’y ve Ehl-i hadîs ekollerine mensup âlimlerin hadislere yaklaşımlarını göstermesi bakımından önem arzetmektedir. Burada vermiş olduğumuz hadisler üzerindeki tartışmalar bu iki ekolün uluhiyet anlayışını, haberî sıfatlara yaklaşımlarını ortaya koyduğu gibi bunların genel anlamda hadis perspektifi hakkında bizlere bilgi vermektedir.ÖzetBu araştırma, temel hadis kitaplarının yazıldığı dönemde, yani III./IX asırda, haberî sıfatlar ihtiva eden bazı hadisler üzerinde yapılan tartışmaları ele almaktadır. Tartışma Osman ed-Dârimî (ö. 280/894) ile Bişr el-Merîsî’nin (ö. 218/833) taraftarları arasında geçmektedir. Hadisler üzerinde Ehl-i hadîs ile Ehl-i re’y mensubu âlimler arasında gerçekleşen bu tartışmalar bir yönüyle hadislerin anlaşılması ve yorumlanmasını ilgilendirmektedir. Tartışmanın, burada ele alınan hadislerin nasıl anlaşılması gerektiği; lafızların kelime anlamı mı (literal) yoksa bu lafızların ötesindeki muhtemel mecazî anlamları dikkate alınarak mı anlaşılması gerektiği noktasında odaklandığı söylenebilir. İnceleme konusu yapılan hadisleri tartışan tarafları kısaca tanıtmak yerinde olacaktır. Sözünü ettiğimiz rivayetlerle ilgili tartışmalar Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında geçmektedir. Ehl-i hadîs’in önemli simalarından biri olan Osman ed-Dârimî, hadislerle ilgili bu tartışmaları içeren ayrı bir eser yazmıştır. Bu eser, Allah’ın sıfatları ve bazı hadis meseleleri konusunda Bişr el-Merîsî ve onun iki talebesinin görüşlerine reddiye olarak yazılmıştır. Bişr el-Merîsî, Ebû Yusuf’tan (ö. 182/798) fıkıh tahsil etmiş, önemli bir kelâmcı olarak tanınmıştır. O, kelâmla ilgili konularda aralarında İmâm Şâfiî’nin (ö. 204/820) de bulunduğu pek çok âlimle ilmî tartışmalar yapmış bir ehl-i re’y âlimdir. Halife Me’mûn’un (ö. 218/833) danışma meclisinde bulunmuş, Kur’ân’ın yaratılmışlığı (Halku’l-Kur’ân) görüşünün benimsenmesinde önemli payı olmuştur. Osman ed-Dârimî ise, Yahyâ b. Ma’în (ö. 233/848), Ali b. Medînî (ö. 234/848-49), İshâk b. Râhûye (ö. 238/853) ve Ahmed b. Hanbel (ö. 241/855) gibi döneminin otoritelerinden hadis öğrenmiş bir ehl-i hadîs âlimidir. Hadis tahsili için önemli bütün şehirleri dolaşarak hadis öğrenmiş ve rivayette bulunmuştur.Haberi sıfatları ispat ve bunlarla ilgili rivayetlerin teviline karşı çıkan anlayış ile, bu rivayetlerin tenzih anlayışına uygun biçimde tevilini savunan kesimler ilk dönemden itibaren eserler telif etmişlerdir. Osman ed-Dârimî’ye göre, ehl-i hadîs’in eleştiri edebiyatının ortaya çıkmasında, Mu’tezile’nin ilahî sıfatları reddetmesi etkili olmuş ve pek çok müellif bu yönde eserler yazmışlardır. Ebû Hüreyre’den nakledilen bir rivayetle ilgili olarak muârız, bu rivayetin Allah için bildiğimiz göz ve kulak organlarından oluştuğu izlenimi verildiğini söyler. Osman ed-Dârimî, bu hadisin göz ve kulak organlarını değil görme ve işitmeyi ispat ettiğini söyler. Hiçbir konuda Allah’ın benzerinin bulunmadığını belirtir. Dolayısıyla Allah’ın organlardan oluştuğu iddiasını ehl-i hadîs’e nisbet etmek iftiradır. Ebû Dâvûd, bu hadis ile Allah için görme ve işitme sıfatlarının ispat edildiğini ve Cehmiyye’nin ilahî sıfatları inkar görüşüne reddiye olduğunu belirtir. Ebû Hüreyre’in Hz. Peygamber’e nispet ederek naklettiği: "İman Yemenlidir, hikmet Yemenlidir! Ben Rabbi’nizin nefesini Yemen tarafından hissediyorum!" rivayetini de muârız münker kabul etmiştir. Çünkü Bişr el-Merîsî ve ashâbına göre nefes ancak karın boşluğu olanlardan çıkar, Allah ise bundan münezzehtir. Osman ed-Dârimî’ye göre, muârız yanlış anlamıştır. Burada kastedilen, Yemen tarafından esen ve insanı rahatlatan rüzgardır. Bu rivayet bağlamında bakıldığında, Bişr el-Merîsî taraftarlarının rivayeti literal değerlendirdiğini, Osman ed-Dârimî’nin ise rivayeti yorumladığını görmekteyiz. İbnü’s-Selcî, "Siz, Allah’a ondan çıkandan (Kur’ân’dan) daha faziletli bir şeyle yaklaşamazsınız!" rivayeti hakkında, Müşebbihe’nin bunu, karın boşluğu olan, kendisinden kelâm çıkan şeklinde anladıklarını belirtir. Allah boşluğu olmayan anlamında "samed" olduğundan bu anlayış geçersizdir. Bu hadisle, Kur’ân’ın Allah’tan değil O’nun katından çıkması kastedilmiştir. Osman ed-Dârimî’ye göre, İbnü’s-Selcî’nin asıl maksadı Allah’ın kelâm sıfatını inkâr etmektir. Kur’ân’ın O’ndan çıktığında bir şüphe yoktur, bunu sadece kelâm sıfatını kabul etmeyenler inkâr etmektedir. İbn Abbâs’a atfedilen; "Rükn (Hacerülesved) yeryüzünde Allah’ın sağ elidir, halk ile onunla musafaha eder" rivayetinde geçen "yemînullah" (Allah’ın sağ eli) sözünün anlamı, İbnü’s-Selcî’ye göre bildiğimiz sağ el değil, Allah’ın nimeti ve ikrâmıdır. Hacerülesved ile elin kastedilmediğini kabul eden Osman ed-Dârimî’ye göre, İbnü’s-Selcî’nin maksadı, geçersiz te’villerle Allah hakkında ayet ve hadislerde belirtilen iki eli inkar etmektir. İbn Abbâs’ın Hz. Peygamber’den naklettiği başka bir rivayeti İbnü’s-Selcî’nin eserine alıp nakletmesini eleştiren Osman ed-Dârimî, bu tür zayıf rivayetlerin yayılmaması gerektiğini söyler. Buna ilave olarak İbnü’s-Selcî’nin yaptığı yorumun da çirkin olduğunu belirtir ve eleştirir. Çünkü sözü edilen rivayette Allah, yeşil bir takım elbise giymiş kıvırcık saçlı bir genç olarak tasvir edilmektedir. Böyle bir rivayet Hz. Peygamber’den gelen sahih rivayetlerle çeliştiği için de güvenilmez bir rivayettir. Rivayetle ilgili bu değerlendirmeyi yapan Osman ed-Dârimî, rivayet hakkında muârızın yaptığı yorumları da reddeder. Muârıza göre, "Rabbimin yanına girdim" sözü, "Adn cennetinde Rabbimin huzuruna girdim" demektir. Osman ed-Dârimî’ye göre bu gibi müşkil (problemli) hadisler re’y ile tefsir edilmemeli, rivayet edilip bırakılmalıdır. Hz. Peygamber’e dayandırılan ve Allah’ın kendisine geldiğinden bahisle cevabını bilemediği bazı sorulan sorduğundan, sonra Rabbinin elini sırtına koymasıyla parmaklarının serinliğini hissettiğinden ve her şeyi öğrendiğinden bahseden rivayetle ilgili olarak muarız şu değerlendirmede bulunur: Allah Resûlü’ne gelen Rabbi değil güzel suretli bir melekti, o melek Allah tarafından yönledrilmekteydi ve elini koyan da o melekti. Osman ed-Dârimî, muârızın bu yorumunu reddeder. Bu yorum aynı zamanda diğer sahih hadislere de aykırıdır. Osman ed-Dârimî, sözkonusu rivayet hakkında muârızın yorumunu reddettikten sonra zikrettiği sahih rivayetlere dayanarak buna güvenilemiyeceğini ifade etmiştir. İlahî sıfatlar hakkında konuşmak en zor konular arasında görüldüğünden, selef âlimleri bu konuda susmayı tercih etmişlerdir. Ancak sonraki nesiller bu konuda farklı yollar tutmuşlardır. İlahi sıfatları anlama konusundaki temel yaklaşımları tefvîz, teşbîh ve te’vîl şeklinde üç ana başlıkta toplamak mümkündür. Tefvîz, selef alimlerinin benimsediği yol olup, Allah’ın zâtı ve sıfatlarının mahiyetine ilişkin bilgiyi ilâhî ilme havale etmek demektir. Teşbîh, Allah’ı yaratılmışlara veya yaratılmışları Allah’a benzetmek anlamına gelir. Te’vil, Allah’ın yaratılmışlara benzediği izlenimini veren ayet ve hadisleri dil bilimi ve aklî bilgilerle yorumlamaktır. Sıfatları inkar edenlere Muattıla denilmiş, sıfatları ispat edenler Sıfâtiyye diye anılmıştır. Ehl-i re’y’e göre Allah’a atfedilen ve sözlük anlamı bakımından teşbîh ve tecsîm izlenimi veren sıfatları uygun biçimde te’vil etmek gerekir. İlâhî sıfatlarda Mu’tezile tenzihi öne çıkarmış, Eş’ariyye ve Mâtürîdiyye ise tenzihe uygun te’vili benimsemiştir. Müşebbihe, Vehhâbî-Selefî anlayış da ilahî sıfatlardaki lafızları zahiri anlamlarıyla almışlardır. Hadis ilminde en önemli temel eserlerin telif edildiği II./VIII. ve III./IX. asırda yaşamış olan âlimler arasında cereyan eden inceleme konusu yaptığımız tartışma, ilk döneme ait olması bakımından önemlidir. Bunun yanında tartışma, âyet ve hadislerden oluşan naslara yaklaşımda, iki temel yaklaşımı göstermesi bakımından da önemli bilgiler ihtiva etmektedir. Bu iki temel yaklaşımdan biri ehl-i re’y ekolünü, diğeri ise Ehl-i hadîs anlayışını temsil etmektedir. Osman ed-Dârimî genel olarak rivayetin lafzına bağlı kalmayı savunmakta, Bişr el-Merîsî ve ashâbı ise münker olduğu gerekçesiyle rivayeti eleştirmekte ya da te’vil etmektedir. Nadir de olsa Osman ed-Dârimî’nin rivayeti ret ya da te’vil ettiği, Bişr el-Merîsî ve ashâbının ise rivayeti savunduğu yerler de görülebilmektedir. Müteşâbih (problemli) rivayetler hakkında Bişr el-Merîsî’nin yaptığı te’viller sonraki âlimler üzerinde etkili olmuştur. Onun te’villeri, Cübbâî (ö. 303/916), Kādî Abdülcebbâr (ö. 415/1025), Ebü’l-Hüseyin el-Basrî (ö. 436/1044) gibi Mu’tezilî âlimlerin yanı sıra, İbn Fûrek, Gazâlî (ö.505/1111), İbn Akîl (ö. 513/1119), Fahreddîn er-Râzî (ö. 606/1210) gibi sünnî âlimler tarafından da iktibâs edilmiştir. Rivayete dayalı olan hadis ilminde hakikatin ortaya konulabilmesi, "rivayet" ve "re’y" seçeneklerinden birini tercih etmekle değil; bunların her ikisini de yerinde ve dengeli olarak kullanılmasına bağlı olduğunu hatırda tutmak gerekir. Hakikatin ortaya çıkarılmasında rivayet re’ye, re’y de rivayete muhtaçtır. Rivayet ve re’y birbirinin rakibi değil tamamlayıcı unsurları olarak görmek gerekir. (shrink)

Çağdaş epistemoloji içerisinde, dışsalcı, güvenilirci ve erdeme dayalı epistemolojik tartışmaların bir benzerini, dini epistemoloji içerisinde etkili bir şekilde yer edinen ve reformcu epistemoloji olarak bilinen yaklaşım üzerinden görebilmek mümkündür. Alvin Plantinga, Nicholas Wolterstorff ve William Alston gibi filozofların öne çıktığı bu yaklaşımın ana iddiası, kanıta ya da argümana dayanmaksızın, Tanrı’nın varlığına inanmanın bütünüyle doğru, rasyonel, makul ve güvenilir olacağı şeklindeki bir tezdir. Kanıtın, gerekçelendirme için zorunlu bir koşul olmadığı fikri, algısal deneyimlerin gerekçelendirilmesine benzer şekilde, dini deneyimlerin de öyle olduğu ve (...) dolayısıyla, aynı epistemik statüye sahip olması gerektiğini öne süren, eşitlik tezine dayanır. İlk ortaya çıktığı günden bugüne, üzerinde çokça konuşulan ve tartışılan bir yaklaşım olan reformcu epistemoloji, özellikle son beş yıl içerisinde, oldukça farklı bir hale gelmiştir. Zira bu yaklaşımı, kanıtsalcılıkla uyumlu, erdem epistemolojisiyle bağlantılı ve diğer teistik dinler üzerinden değerlendiren yeni çalışmalar ortaya çıkmıştır. Bu nedenle, bu makalede, reformcu epistemoloji ana hatlarıyla ele alınmıştır. Beraberinde, ona yöneltilen itirazlara değinilmiş ve sonrasında, bahsi geçen yenilik iddiaları soruşturulmaya çalışılmıştır. Muhyiddin ibn Arabî, İslam'daki tartışmasız en etkili sufi teorisyendir. Kalıcı şekilde en popüler çalışması olan Fusûsül-hikem'de, Kur'an'da bir peygamber hakkında algımız ne olursa olsun, onunla ilişkilendirilen ve ondan türetilen hikmetin çok farklı olduğunu açıkça ve ısrarla göstermektedir. Bu, İbn Arabî'nin Kur'an'ın literal metnini inkar ettiği anlamına gelmez. Tam tersine, O sadece Kur'an'ı farklı algılama ve alımlama düzeylerinin olduğunu iddia eder: Kur'an'ın dış gerçekliği (zâhir) kitlesel tüketim içindir ve İbn Arabî'ye göre kişinin Kur'an'ın yüzeysel bir anlayışından elde ettiği bilgidir. Bununla birlikte, (...) Kuran'ın, ariflerin (arifûn) korumasında olan daha derin bir anlayışı vardır. İbn Arabî, dış gerçeğin ötesine geçen, ancak ona (dış gerçekliğe) ayrılmaz bir şekilde bağlı olan Kur’an’ı bu şekilde okumasıyla, Kur'an'ın tasavvufi tefsir geleneğini kendi tarzında sürdürür ve birincil amacını Fusûs’un her bölümünde uygular: Her ikisinin de meşruiyetini korurken, Kur'an'ın zâhir ve bâṭını arasındaki antitezi vurgulamak ve hatta bâṭına ancak ẓâhir yoluyla erişilebileceğini iddia edecek kadar ileri gitmek. Bu makale, bu karşılıklı bağımlı bilgi ('ilm)/hikmet (hikma) antitezinin en açık örneklerini bulduğumuz ve belirli nedenlerle seçilmiş Fusûs'un dört bölümünü detaylı şekilde incelemektedir: Adem bölümü, Fusûs'un ilk bölümü olduğu için seçilmiştir ve bu bölümde İbn Arabî'nin eserin tamamına yönelik amacı ve yaklaşımı net şekilde belirginleşir. Lût ve Hârûn bölümleri, Endülüs'ün ikili hermenötik ilkesinin en bariz örneklerini oluşturdukları için seçilmiştir. Son olarak, İbn Arabî metnin tahiriyle çelişiyor gibi görünse bile, aslında birincil zahiri modele dayanan daha gelişmiş bir yorum modelini açıkladığı için Nûh bölümü seçilmiştir. Âdem bölümünde İbn Arabi, Adem ile ilişkilendirilen en tutarlı Kur'anî betimlemenin insanlığın babası olduğu için onun insanlığının olduğunu öne sürer. Oysa onun hikmeti ilahi vasfıdır. Bunun nedeni, İlahi en katıksız ve tam ifadesini ancak insanda bulabilmesidir. Diğer taraftan, Nuh'un Kuranî sembolü ise kavminin büyük çoğunluğunun boğulduğu tufandır. Sufî’ye göre (İbn Arabî) onun hikmeti, şeyleri yüzdürmesidir- subbūḥiyya/sebūḥiyya hikmeti. İbn Arabî için boğulma bir ölüm nedeni olmaktan çok bir yaşam kaynağı olmuştur. Lut'un Kur'an'daki en kalıcı imgesi, kavminin günahını dizginlemedeki yetersizliğinden dolayı güçsüzlüğüdür. İbn Arabî, ama yine de onun hikmetinin güç olduğunu söylüyor. Son olarak, Hârûn, Kuran'da Mûsâ'ya itaat eden biri olarak tasvir edilir. Kardeşine yardım etmesi, yükünü taşımasına yardım etmesi için kendisine peygamberlik verildi. Mûsâ, Sina'ya gidip onu sorumlu bıraktığında bile, o sadece Mûsâ'nın yardımcısı rolünü yerine getirir ve ona tabidir. Oysa onun hikmeti itaatin, liderliğin antitezidir. (shrink)
